Hello guys! I'm writing this post because I had a problem with an user named sslim66

 

We had two transactions. I was the buyer, he was the seller.

 

The first one included 3 books for $380 + shipping. I asked for a priority mail international with insurance shipping to Europe. He agreed and told me shipping cost $50, then I paid and he sent the books.

 

However, he did not sent the books via Priority and did not put insurance. He also declared a $45 value. Luckily I got the package and everything was fine but one thing: the shipping cost $26 instead of $50. Also, the box he sent me was a box he had received from another guy, so he didn't have to pay for buying it. When I was about to ask him for a refund he told me he had lost his job, so if I wanted to purchase some more books I'd have been welcome.

 

 

I purchased a few other books from him because I thought he needed money and asked again for a priority shipping. I didn't want to pay $50 and be fooled again, so I told him the shipping with priority should have cost around $39 because I got some other books shipped via Priority for $39. He said it was ok, so I paid and he shipped a few days later. He said he shipped first class for $35, and at that moment I got a little bit angry, since it was the second time he didn't ship with the method I told him to ship. I asked for a $4 refund, but he said it was for gas + box. Then I told him that he made me pay $50 instead of $26 for the first transaction's shipping, but he just ignored me and left the conversation.

I haven't received the last package yet.

 

I'm asking for a $24 refund for the first transaction + some dollars refunding the difference between the cost of the last transaction's shipping and what I paid, which is surely at least 4$, since I paid $39 and he said the shipping cost $35.

I asked for the posts receipt of the last shipping, but he hasn't answered yet.

I wrote a post on his kudos thread saying he had fooled me. He wrote some bad posts as well on my kudos thread and his one, which I answered to. Then we started talking privately and he also started insulting me: http://postimg.org/image/ox4twofmd/

 

Then I told Architecht about what happened and he suggested me to write on this thread and deleted my and slim66's kudos threads.

 

I'd like to get my money back, but if this won't be possible at least I have told the board what he's done and maybe you can do something for stopping him fooling and insulting people again.

Seller owes you a refund of $28 ($24 on the first package and $4 on the second package, since he didn't ship them as specified).

 

This is assuming the second package arrives to you safely.

 

Is he charging for insurance that wasn't visible to the recipient? I know every time I get a USPS package from Sarasota, the label has an amount that is nowhere near what I paid.

We don't know. The seller removed himself from the conversation. As It stands...the seller either owes money or an explanation.

 

I'd definitely want a refund, and I would never deal with him again. Why would you tell somebody you're shipping it one way, charge them for that method, and then ship a different way for less?

Agreed, while oceanavekid could have been a bit more direct, I just don't see this particular case against him being PL worthy.

 

Then where is the line where we hold a seller responsible for completing a sale

 

Sorry was at work. My reply to this is certainly not after he tells the potential buyer he is not going to sell it to him.

Okay, fine, we can disagree but to me what he said was close enough to an "I'm keeping the book".

 

 

Only if "Keeping" is synonymous with "Ebaying", otherwise it's a straight up lie. lol

 

even if its a lie, I don't think you can infer that he meant sell on ebay at a higher price AND keep selling on the boards at a lower price, specifically after he told the guy he priced it too low. If that were the case, he would have honored the lower price sale, as the ebay fee difference would have negated most of the profit.

 

This is a careless administrative error, unfortunately made by someone with a history of careless administrative errors who ran into someone who wanted to force the issue. The buyer (admittedly inexperienced) should have notified the mods and the seller of the rule breaking, not threw up an "I'll take it" when he knew the comic was on ebay at a higher price and after being told that the seller was going to 'keep it BECAUSE HE THOUGHT IT WAS PRICE TOO LOW'.

 

 

Right, the meaning to me is, you can't believe anything that he tells you. Whether it's because of careless whispers or intentional dinkbaggery, he's doing business in a medium that requires words being expressed in a clear and unambiguous way when doing so seems to be his kryptonite.

However, I'm demanding $24 for the first shipping and $4 for the second. When the second package arrives I'll see if it really cost $35 or not. If it didn't cost $35 I will ask for another refund of the difference between $35 and the real cost.

 

We had a conversation in my and his Kudos Threads, but our posts were deleted by a moderator. I know that the Kudos Threads are not for having disputes, and it's right that the posts were deleted, but unluckily you can't see what we said to each other on those threads. Maybe a moderator can still read them.

 

Luckily the first package he sent me was perfect ( the books inside were great, the box was a lot larger than them though), but as I said before it had no insurance ( it's not available for first class), which was too risky for a $430 transaction.

The second time I asked for priority, but as before he didn't sent them via priority, but first class.

They clearly say it is a First Class Package International Shipping, which doesn't even have italian tracking. Priority does have Italian tracking, this is why I wanted the packages to be shipped via Priority.

If he committed to buy them in the messages I consider that the same as :takeit: so wouldn't that be PL worthy? I always like to give people the benefit of the doubt that it is a mistake, but usually it is what it appears to be.

 

Yep, we'd get a batch together, negotiate, he said :takeit: and then move on to see what else we could add in to the shipment. Again, I'll feel horrible if something happened to the guy but if he was/is a fly-by-nighter, people may want to be wary of dealing with him should he ever pop up again. 2c

Sorry guys, never nominated anyone to PL before, wanted to make sure I was doing it right.

 

The PM exchange is lengthy as we talked comics a bit too...Guy seemed decent enough too, which is why I was willing to drag it out and get the guy some more books....Sigh...Here are a few of his replies.

It is at this point I said ok, final list of some books we had talked about based on his want list that is pretty much when communication from him stopped.

 

I sent a PM yesterday advising of my intent to nominate mjc71 to the PL.

 

As noted, I sent mjc71 a PM on 06/10/14 advising of my intent to nominate him to the PL.

 

No response.

 

As such, I'd like to officially nominate him for non-payment after committing to buy and basically wasting my time.

I dont know anymore. (shrug) I thought I understood this list finally but now I know less than before. So if he shows up in a week and asks to be taken off because he was in Siberia and couldn't respond does that take him back off??
