You absolutely should seek advice from counsel, and should do so now (and before discussing case details with any third parties on, say, Zoom calls or whatnot). 

It's possible that there are no assets to seize. Mike certainly wants you to believe there are no assets to seize. He also wanted the bankruptcy court to believe that there were no assets to seize, but there are, shall we say, reasonable questions about whether that filing was accurate.

I was under the impression at the time that it was going to be done by leaf casting, but perhaps he was going to do the dry grafting instead. 

Same with my FF1. He was going to use dry grafting to remove the trimmed designation. I was passing through Oregon and had planned to drop off the book, but thankfully I forgot it at home. 

(FYI - this was a book that CGC said was trimmed on the top. I had it regraded and now it's trimmed on the bottom instead. )

Regarding Mike's skill level, he did some major restoration on the first book I sent him almost a decade ago (an early Adventure Comics) which included leaf casting, color touch and lots of other stuff (brought a low grade 3.0-4.0ish up to a 6.5, which was less than we had hoped but still looked nice). 

I felt he knew how to do the stuff needed on most jobs, though quality might vary and often with a 'heavy hand' so more restoration was applied when less would have been possible, so him taking on work he could NOT do never crossed my mind. Also consider he didn't personally restore all the books sent to him - he sometimes sent the books to OTHER restoration pros to do in order to help him catch up on work (won't name em)....so in those cases those clients might have ended up getting even better work than everyone else.

I can understand why it might seem hopeless, but there may be assets that are not known.  Or there might be more assets that one might have access to in the future (income, inheritance, lottery).  Also getting more victims involved MAY help keep others from being victimized in the future in the way of harsher legal or criminal or civil penalties assessed.  For example - not being able to get loans or business licenses or entering other contracts or bankruptcies, or longer sentences (if it gets to that point).

It might be a mistake to think of it as hopeless. It's also a mistake to give much in the way of false hope.  It is far, FAR easier to get judgements than it is to COLLECT on judgements.  It costs money to look for assets. It costs money to go back to court repeatedly to try to get payments.  Let's say the person gets a job and you go to court for a garnishment. They pay a few months and quit that job. Rinse and repeat, over and over.  And if they move to another state from where the judgement is at....... 

I was personally involved in getting small claims judgements where I worked. Direct point of contact with our attorneys. We just quit bothering after a few years because we spent more money than we collected.  There were a couple - I mean two out of a couple of hundred - judgements where years later money was collected.  In both cases the person with the judgement against them got married and the new couple went to get a mortgage to buy a house. The bank said no because of the outstanding judgement. So they came in and paid. 

By all accounts, Mike owes a LOT of money. Just one person here said $65,000. Money collected is going to be a very long shot proposition.  Some say false hope is better than no hope, but it's not something I have ever thought to be true. Those joining in an effort at collecting $$ via civil action would be wise to find an attorney that will work for JUST a percent of what is collected. Otherwise the truth is people will just compound their losses with attorney fees. 

Here is something else I'll share. Sorry to be a Johnny Raincloud.  I also worked with the local prosecutors office and some people got charged with felonies.  The criminal justice system doesn't have a lot of enthusiasm for incarcerating  people with a lot of health problems. Least not here. They don't want to pay their medical bills.  So if Mike really does have a bunch of health issues that reduces the chance of meaningful jail time. Still is worth nagging at authorities about criminal charges. Even if a conviction leads to probation, compensation to the victims will no doubt be ordered. Now you have a judgement for free. Which might be all it's worth, but still.....

So I respect what you've said.  As far as being a raincloud or anyone providing 'false hope'.  I'm not sure of anyone else, but I don't have any expectations of getting anything back.  But to not try is criminal.

Super late to this discussion.. I have an email from Mike.. in Nov 2023 stating he was backed up and would get back to me.  This was from the contact@hrcomics.com account. He has my ASM 15. I know it was disassembled a couple years ago to add a page (that was missing and purcheds seperatly). I know it isn't a huge book but I would like to get it back or some of the money I paid for it. 

Currently my emails are going unanswered. I have seen random solutions on this thread. Can someone give me next steps? I think I paid him with my credit card.. but like many of you my preference is to get my book back.. even if it is in pieces.. it took a long time to round up the exact missing page to make it complete (married).

Jeez....he was still accepting in Nov of 2023...  You may be one of the lucky ones that can get the credit card company involved.  I would contact them immediately.  Most don't have that option because it has been years or decades.  Sorry about your ASM 15

When you say that he said he was "backed up" is that him admitting that he is quite literally full of excrement ?

Please be careful of Flake Tapper and do not give him any money you are not comfortable loosing.

I am sure his zoom calls to discuss legal action are totally legit but nothing he has actually posted supports that yet.

 

As for your predicament; you are out money and will 99.999% never see any reimbursement. Your book is likely still in pieces and worse off than original, from reading the comments Mike has stopped all communication, has sold customer books, reported others as "stolen" (he likely sold them), and seems to just be ignoring everything laying low.

Winning a civil case against Mike will not be difficult, collecting on any judgement will. In addition that judgement will first go to additional attorney fees then to (all) customers. I am not telling you to give up, but moderation of expectations is needed after you file the appropriate disputes with the AG, police, etc.
